Family members of an Army man, who died in a road accident involving a rashly driven truck, have been awarded a compensation of around Rs 55 lakh by a Motor Accident Claims Tribunal (MACT) here.
The tribunal directed National Insurance Company Ltd, with which the offending truck was insured, to pay Rs 54,54,520 to the wife, two children and mother of Kuldeep Chand, who died in the accident in 2014.
"After considering all the documents filed by the petitioners as a whole and the testimonies of eyewitnesses, it is clear that the driver of the truck was driving the vehicle in a rash and negligent manner," MACT Presiding Officer Sanjeev Kumar Singh said.
55-year-old Chand's family told the tribunal that he was working as a Hindi Translator with Directorate General ITB Police in the rank of Subedar (Major) and earning over Rs 73,617 per month. The family had approached the tribunal claiming a compensation of Rs 1 crore.
The family, which resides in Himachal Pradesh, said in their petition that the incident took place on May 19, 2014, while Chand was walking to the Kashmere Gate Metro Station when the offending truck came at a high speed and hit him from behind.
It said the truck was being driven in a rash and negligent manner and the victim fell down on the road and died on the spot.
The truck driver, in his written statement, denied his involvement in the accident.
