Rs 14L compensation for fruit seller for disability in mishap

A 45-year-old man, who suffered disability in a road accident involving a rashly driven truck, has been awarded a compensation of over Rs 14 lakh by a Motor Accident Claims Tribunal (MACT) here.
MACT Presiding Officer Kiran Bansal directed the New India Assurance Company, insurer of the offending truck, to pay a compensation of Rs 14,45,027 to 45-year-old Dharam Pal, who was on a bicycle when he got hit by the negligently driven truck in 2011.
"From the statements of Dharam Pal and in view of the record of the criminal case regarding the accident, it is proved that he sustained injuries in the accident due to rash and negligent driving of offending vehicle by its driver," it said.

The tribunal relied on the medical report of the victim showing that he suffered 80 per cent disability on his left leg and also took into record the documents submitted by him including FIR, medical bills and mechanical inspection report.
According to the petition filed by Pal, on October 13, 2011, he was going to Sahibabad, UP by his bicycle when all of a sudden the offending truck came and hit him from behind.
Due to the impact, he sustained grievous injuries and underwent treatment for over two months, it said.
The driver and owner of the truck were proceeded ex-parte as they failed to appear before the tribunal. The insurance company, through a written statement, had denied the allegations.

Pal, a fruit seller, had claimed that he was earning a monthly income of Rs 10,000 and the accident had left him disabled as he could not carry out his day-to-day activities.
