Former Supreme Court Justice A K Ganguly today said National Judicial Appointments Commission (NJAC) is not a solution to the shortcomings present in the collegium system for appointment of judges.
"In my view, the Supreme Court has taken this decision to protect and uphold the independence of the judiciary which is at the heart and soul of the Indian Constitution," Ganguly told PTI.
Admitting that the two-decade-old collegium system of appointment of judges has some flaws, he said NJAC is not a remedy to the problem.
"NJAC has the in-built potential of creating interference in the functioning of the judicial system. We need to improve the collegium system to make it more transparent and objective," Ganguly said.
The Supreme Court has struck down as unconstitutional the NJAC Act that was brought in to replace the over two-decade-old collegium system of judges appointing judges in the higher judiciary.
