State reason for rejection of candidature: HC to TNUSRB

The Madras High Court has asked the Tamil Nadu Uniformed Services Recruitment Board to state the reason for rejection of candidature of job aspirants and mandatorily mention the remedy available in intimation letters.
The order was passed by a division bench of Chief Justice Sanjay Kishan Kaul and Justice S Manikumar on an appeal by Rajesh Kumar of Kanyakumari district who was declared medically unfit for the post of Tamil Nadu Special Police Youth Brigade after he cleared the written test.
The Madurai bench of the court also directed Kumar to go for fresh medical examination in accordance with norms, within one month, to determine his qualification.

He had challenged the December 23, 2014 order of a single judge of the court dismissing his petition against the rejection of his candidature.
"We are of the view, all candidates may not be knowing the remedy for such medical rejection... So the rejection letter must mandatorily state the remedy available," the bench said.
The appellant submitted he had appeared for the examination for recruitment of personnel for Tamil Nadu Special Police Youth brigade 2013-14.

He was issued provisional selection-cum-medical examination letter. However, after medical examination, he was orally told that he had cross legs, making him medically ineligible for the force.

When Kumar filed an RTI query, he found the medical report showed he was fit for police service.
The government pleader said the appellant could have subjected himself for medical examination again if it was known to him that he could avail appeal remedy against adverse medical report within 30 days.
Noting that the appellant came know of the order only through RTI very late, the judges directed the authorities to mention the reasons whenever they reject any candidate in future.
