"Tainted" probe in rape case:Police chief asked to take action

The Delhi Police Commissioner was today directed to constitute a team of officials headed by an ACP to further probe a rape case lodged by a girl against her father, by a court which also asked the top cop to take action against erring policemen for "tainted" investigation.
Additional Sessions Judge Pawan Kumar Jain here directed police chief B S Bassi to submit the report within two months in the court.
"It becomes abundantly clear that court has ample power to direct the police to conduct further investigation under Section 173(8) of CrPC, thus, I hereby direct Commissioner of Police to constitute a team of suitable police officers headed by Assistant Commissioner of Police (ACP) to conduct further investigation of the matter and direct him to submit further report within a period of two months to this court.

"Copy of order be sent to the Commissioner of Police for compliance. Commissioner of Police is further directed to take appropriate suitable disciplinary action against the erring police officials/officers as he deems fit under intimation to this court," the judge said.
The court passed the order while dealing with a rape case filed in May, this year at Sabzi Mandi Police Station here by a 22-year-old girl against her father, alleging that he had been repeatedly raping her since the time she was 12-years-old.
The court pulled up the police for not investigating the matter "fairly and impartially", leaving numerous loopholes in the probe.

"In fact no effort was made to find out the truth in the matter. Rather charge sheet has been filed by mere recording the statement of few witnesses. No effort was made to find out the truth in the allegations levelled by the complainant. Even no effort was made to seek explanation either from the victim or from the accused," the court said.
"It becomes clear that matter had not been investigated properly, fairly and diligently. The investigation is not only totally unsatisfactorily but it is also tainted and conducted in most casual and irresponsible manner," it said.
The girl, in her complaint, has alleged that her father was an alcoholic and drug addict and he used to repeatedly rape her and on refusal, he would beat her up.
