Kevin Roper Roper was driving a Wal-Mart truck in June 2014, when he crashed into the limo bus carrying the former "Saturday Night Live" star and his friends, seriously injuring the comedian and killing his friend.
Morgan, 47, was in a coma for two weeks after the accident and recently said that his life would never be the same.
Roper's indictment comes a week after a judge refused to throw out criminal charges after David Glassman, Roper's attorney, claimed his client is unable to get a fair trial because of negative publicity surrounding Morgan's federal lawsuit against Wal-Mart, reported USA Today.
Morgan settled with Wal-Mart this summer for an undisclosed amount.
The truck could have avoided the collision with the Mercedes Benz limo van if Roper had obeyed the 45 mph speed limit and started braking earlier, the NTSB ruled.
Morgan returned to the public spotlight this fall, hosting "Saturday Night Live" and saluting Eddie Murphy at the Kennedy Center.
