The shoe, hurled by Madan Chavan, a robbery case accused, didn't hit the judge as it reached only till the edge of his dais, police said.
Chavan is lodged at Arthur Road jail since his arrest in 2003, they said.
The incident took place when he was produced in the court of sessions court judge S V Patil today.
When policemen caught hold of the undertrial, he abused the judge, a police official said, adding Chavan was frustrated over the delay in the trial in the case.
The police have registered a case against him under relevant sections of IPC including sections 504 (intentional insult) and 353 (assault on public servant).
