Taking umbrage at the state government not filing supportive documents in favour of its claim that it was a case of railway accident, Justice Dipankar Dutta said though the petitioner has filed the case seeking CID investigation, the state lawyer would have to explain why should the court not hand over the probe to CBI.
On March 13 this year, a youth named Rahul Roy was rescued from near Gurudaspur Halt station in the eastern part of the city in a severely injured state with his legs severed.
An FIR had been filed against 12 persons alleging attempt to murder Roy.
Justice Dutta today questioned the state lawyer that though it was being said to be a case of railway accident, there was no supportive document like GRP's report that it was an accident.
The court also said that the post mortem report led to some questions like dragging marks on the shoes of Roy, which have remained unanswered.
