"Why is the central government not implementing it? Why the delay," Justice J R Midha asked while issuing notice to the Centre and seeking its reply on a petition seeking contempt action against the Home Secretary for not complying with the court's September 9, 2015 order.
The judge directed that a status report with original relevant documents be kept available on the next date of hearing, April 19, and added "respondent 1 (Centre) is to ensure compliance of order dated September 9, 2015 by division bench of this court in writ petition (criminal) 1549/2009 before next date of hearing if not already complied with".
The contempt petition filed by Delhi Prosecutors Welfare Association has alleged "deliberate and willful disobedience" on the part of the Centre and city government in complying with the court order.
Meanwhile, senior advocate Ram Jethmalani, who appeared for the lawyers' body, said he would also take up the matter with the central government for expeditious compliance of the court's September 2015 order.
The association, in its petition filed through advocate Ashish Dixit, said assurances to the court by the Delhi government to provide internet facilities to the prosecutors have also not been done.
"The respondent 1 (Centre) and respondent 2 (Delhi government) have demonstrated an attitude which violates the majesty of this court. The respondents deliberately and willfully have not complied with the directions of this court," the petition has said.
