Youth acquitted in rape case, girl resiled from statement

A management graduate, facing trial for allegedly raping his batchmate who later became pregnant, has been acquitted by a Delhi court after she "resiled" from her statement.
"The prosecutrix (girl) had denied that the accused on any alleged false promise of marriage elicited her consent for sexual intercourse..," Additional Sessions Judge Yogesh Khanna said, while freeing the youth, a native of Chhattisgarh.
The youth was arrested on the complaint made by the girl alleging that while she was pursuing her MBA from a college here, she became acquainted with the accused who was in the same batch.
She had further said that since 2011 she started meeting him and even stayed at his flat on several occasions during whic they had physical relations.

The girl, a resident of Delhi and was working as National Head (Auditing) in a private company and had completed her MBA during the period from 2005 to 2007, further said that in February 2012 she became pregnant but suffered a miscarriage due to a fight between her and the youth.
She had told the police that the accused' family mutually agreed to their marriage but later the boy and his parents refused to do so.

However, during her deposition before the court, the girl denied that the accused ever forcibly established physical relations with her.
To which, the judge said that "in view of her deposition that whatever relations she had with the accused were with her own consent and without any concealment or deception on the part of the accused, I felt that there was nothing left in the prosecution case and hence recording of further formal witnesses would have been a sheer wastage of time, thus, vide my separate order I closed the evidence of the prosecution".

"Hence, the accused deserves to be acquitted of the charges framed against him. Thus, acquitted," the court added.
