Youth gets 1 year jail for injuring traffic policeman

A 20-year-old youth who grievously injured a traffic policeman by ramming his bike into the cop when he was signalled to stop has been sentenced to one year in jail by a Delhi court which said that it was a "grave" act.
Additional Sessions Judge Gautam Manan handed down the jail term to south-west Delhi resident Pradeep, who was riding his bike without a helmet and didn't stop despite being signalled by traffic policemen near a flyover in Dwarka here.
"The act of Pradeep of not stopping the bike despite being given signal and instead hitting the cop is a grave act and must have had a demoralising effect on the victim who was on duty of controlling the traffic.
"Managing traffic in Delhi is a big task and as its citizens we should not only religiously obey the traffic rules but help the cause of the police managing traffic. The hostility of Pradeep towards traffic police is unacceptable and he must be informed in clear terms that for his callous act, he cannot escape from jail sentence," the judge said, while relying on other police witnesses.
The court, while convicting him, also relied on the medical report of the head constable who suffered multiple fractures.
The court held him guilty for various offences under the IPC including obstructing public servant from discharging his duties (sec 186), voluntarily causing grievous hurt to deter public servant from his duty (sec 333) and assaulting public servant (sec 353) .
It also held him guilty for the offences of dangerous driving and not wearing a headgear under Motor Vehicle Act.
He, however, was granted bail on a bond of Rs 20,000 for a period of 30 days to file an appeal against the order of conviction and sentence.
According to prosecution, on the afternoon of January 24, 2009, head constable Shyam Lal, along with his team of traffic cops, was on duty of checking vehicles near Dwarka flyover when he saw Pradeep coming on a bike without a helmet.
The constable signalled Pradeep to stop the bike but he instead, increased the speed and rammed the bike against him, causing serious injuries to the victim. Pradeep was arrested by the other cops on duty.
He, however, pleaded innocence and claimed to have been falsely implicated in the case.
