Youth jailed for seven years for raping girl

A Delhi court has sent a youth to jail for seven years for abducting and raping his 18-year-old neighbour, saying the girl's statement was "reliable and trustworthy".
Additional Sessions Judge T R Naval held 25-year-old Sabir guilty of abducting and raping the girl with the help of one of his friends and also asked the Deputy Commissioner of Police of Shahdara district to take action in the case against co-accused Qasim, who is absconding, as the investigating officer (IO) of the case has not taken steps to arrest him.
"The other accused in this case is Qasim. Investigating Officer has not taken appropriate steps for arrest of the accused or for declaring him as a proclaimed offender. A copy of this judgement be sent to DCP, Shahdara District for taking appropriate action in the matter as per law," the court said.
The court also said that Sabir himself had admitted of having physical relations with the girl.
"It was suggested (by defence counsel) to the witness (girl) that she lived with the accused (Sabir) as his wife. Thus, impliedly there is admission on behalf of accused of having physical relations with the accused. These admissions of the accused have corroborated the testimony of the girl," the court said.
It also imposed a fine of Rs 20,000 upon Sabir and said that if realised, Rs 10,000 to be given to the victim as compensation and besides this, she would also be entitled to get other compensation, if available to her under other laws.
According to police, Bihar native Sabir, with the help of Qasim, made the girl smell some intoxicant when she was going to the market and abducted her on April 11, 2010.
A case was registered against the accused after the girl was abducted as her brother had raised suspicion over Sabir.
The police had said the accused took the girl to Mumbai and Sabir raped her several times and thereafter brought her to Ghaziabad from where, on getting an opportunity, she called her family and they rescued her on June 1, 2010.
