Nfl Files Claim Against Karsan

National Fertilizers Ltd (NFL) has filed a counter-claim with Paris-based Chamber of Commerce International (CCI), alleging that officials of the Turkish firm, Karsan, did not fulfil the terms and conditions of the urea supply contract, NFL sources said yesterday.

The NFL claim comes in the wake of Karsans petition with CCI earlier this year in which the Turkish company had accused NFL of breaching the November 1995 contract despite obtaining urea supplies.

NFL, claimed there was no breach of contract, as according to the agreement Karsan was supposed to supply urea till March 1996, with the provision of extending it till September 1996.

NFL, while responding to Karsans claim, filed a counter claim recently charging the Turkish firm with supplying sub-standard urea, the sources said, adding that the petition said the urea supplied was yellowish in colour.Stating that Karsan supplied only a part of urea in November last year, which did not meet the standards, NFL urged the CCI not to consider the claim of Karsan, they said.

India had rejected the urea shipment sent by Karsan in November 1996. Karsan supplied the urea in a bid to avoid legal complications which had arisen after several officials of both NFL and Karsan were indicted in the Rs 133 crore urea fraud case, the sources said.

The CBI has, meanwhile, has continued further investigations as more Indians and foreign nationals have been found to be involved in the swindle.

Recently, names of a Brazilian national and a non-resident Indian figured in the case, who according to CBI were involved in the scam.
