Earlier on August 20, a Delhi additional district judge had told Care that final arguments in the case will be taken up on September 20 whether or not Care filed para-wise replies to the applications and written arguments submitted on August 7 by an author of children's literature.

In two consolidated suits for injunction and accounts filed in 1971, the author, P N Krishna Murthy, has alleged that Care had infringed his copyright in an illustrated work on nutrition entitled `Lakshman Kills a Tiger' after his refusal to publicise an American food commodity.

The court had directed care to maintain true accounts and submit the same in January 1972.

Care had claimed ownership of the copyright by virtue of employment and assignment and had also filed affidavits that its books of accounts were maintained and in its custody, according to law and there was no danger they would be lost, destroyed or not produced in court.

Subsequently, its assistant director Desmond Ignatius had testified in 1985 that Care completely destroyed all its books of accounts and financial records, during the pendency of the case and after its undertaking to the court.
