However the High Court has given HDIL time till September 16, 2013 to appeal in higher court.
Ranjit More of Bombay HC said that HDIL failed to make a case in its favour and dismissed its petition which sought to restrain MIAL from retendering and reodering the SRA project to any third party amongst others. The court observed that prima facie MIAL's termination of rehabilitation contract was not illegal.
In May this year, HDIL said the MIAL terminated the contract with it for the slum rehabilitation project and HDIL had moved court against MIAL, SRA and MMRDA. While MIAL said HIDL failed to perform its obligations, HDIL said the contract was terminated on 'unsubstantial charges.' HDIL posted a quarterly loss of Rs 280 crore after it wrote off Rs 442 crore pertaining to the project in Q4 of FY 2013.
