GSK Consumer Healthcare gets nod to market Horlicks Nutribic

In August, rival Britannia had sued GSK for violations of trademark and copyright of its Nutrichoice biscuits

GlaxoSmithKline Consumer Healthcare (GSK Consumer Healthcare) today said that the company would be able to market its Horlicks Nutribic biscuits again.

In a statement, the company said that the Madras High Court has given approval to GSK Consumer Healthcare to restart marketring on the biscuit brand with immediate effect.

Earlier, in August, rival Britannia Industries had sued GSK Consumer Healthcare for violations of trademark and copyright of its Nutrichoice biscuits. GSK had launched Horlicks Nutribic on August 20, this year.

Britannia had also claimed that GSK had followed the similar packaging style and colour schemeas it had done for about 13 years with its NutriChoice brand.

In an interim order last month, GSK was barred from manufacturing, selling and advertising Horlicks Nutribic biscuits.

“GSK Consumer Healthcare values ethical & responsible business conduct and is deeply committed to compliance with all applicable laws and regulations,” the company said in a statement.

“The registration of Britannia’s NUTRIBIX since 1999, without any bonafide use for the last 13 years could not prevent any person from using any similar mark (like NUTRIBIC),” GSK said in a statement.

GSK Consumer Healthcare sells products under brands including, Horlicks, Boost, Viva and Maltova. In the over the counter category, it sells Crocin, Eno and Iodex.
