While the legal paperwork is being tied up, the debate on whether the party should have walked out of the trust vote when three of their MPs revealed wads of money on the floor of the House is still raging.
In the immediate aftermath of the incident, the party had gone into a huddle trying to decide whether they wanted to participate in what they said later had become a farce of a vote or abstain.
According to top sources, party president Rajnath Singh had put forward the view that the party should walk out from the trust vote since it was the party which had highlighted the fact that MPs had allegedly been bribed to defy their party whip.
"That would have at least hidden the fact that so many BJP MPs had voted for the other side," said a senior leader after the trust vote.
However, after considering the move for sometime, the party finally decided against it. "The fact was that had we abstained and the rest of the opposition had not, then they (Mayawati and the Left) could conveniently say that we had collaborated with the government to save it," said a senior party general secretary.
