The CBI has challenged the discharge of four senior Congress leaders by a special court in the multi-crore hawala case even as the Delhi High Court issued notices yesterday to former Delhi Chief Minister Madan Lal Khurana and three Jain brothers on a petition questioning their discharge.
Challenging the discharge of Congress leaders Madhavrao Scindia, Arjun Singh, N D Tiwari and R K Dhawan by the special judge V B Gupta, the CBI in an appeal prayed for setting aside his May 28 order.
While the matter against the four Congressmen had not come up for hearing, Justice Jaspal Singh issued notices to Khurana, S K Jain, B R Jain, N K Jain and their manager J K Jain for November 10.
The CBI had earlier moved an appeal against Khurana and the Jains.
In a 329-page petition against the four Congress leaders, the investigating agency said there is abudant material which prima facie establishes that the respondents were involved in a criminal conspiracy to pay and accept bribes for influencing decisions.
The petition said the special judge erred in holding that there was no legal evidence. For framing of charges only prima facie case is required to be made out against the respondents, it said.
