The San Francisco-based 9th Circuit Court of Appeals here denied the Trump administration's effort to delay US federal judge's order that blocked imposition of its asylum policy.
The Hill cited the ruling from a three-judge panel of the court that read "We agree with the district court that the Rule is likely inconsistent with existing United States law. Accordingly, we DENY the Government's motion for a stay,"
In early November, the US Department of Justice in a press release had informed that migrants who illegally entered the United States through the southern border with Mexico would be ineligible for asylum. This came as a part of Trump administration's efforts to crack down on illegal immigration
Judge Jon S. Tigar of the US District Court for California later nullified and granted a restraining order against the asylum policy.
"Whatever the scope of the president's authority, he may not rewrite the immigration laws to impose a condition that Congress has expressly forbidden," read the decision ordered by Tigar last month.
Trump had dismissed the judge's decision and continued to do so while ripping into the 9th Circuit.
According to The Hill, the Trump administration said that the court's decision undermined the president's determination that an immediate temporary suspension of entry was required for the increasing crisis that the immigration system faced.
