A Chinese man has asked a local court to announce his 1st born son who is alive to be dead, as he wanted to have another child.

The man, surnamed Hou, went to the district court and asked the court to declare his missing son dead, China Daily reported.

After an investigation, it was found by the court that Hou's son was indeed alive and was living with Hou's former wife.

The man later confessed that he had re-married and wanted to have a baby with his new wife, but it is prohibited from having a second child according to the country's family planning policy.
