Federal court dismisses Stormy's defamation case against Trump

A federal judge on Monday dismissed the defamation lawsuit filed by Adult star Stormy Daniels against United States President Donald Trump.

Daniels had filed a lawsuit following Trump's tweet in which he called her a "total con job", after she opened up about being threatened to not keep shut about the story of her alleged affair with Trump, reported CNN.

District Judge S. James Otero said, Daniels in her argument underlined that Trump's tweet " attacks the veracity of her account" of the incident and that Trump's statement was "false and defamatory, because it charged her with committing a serious crime."

Trump had also asked Otero to dismiss the case. Otero added, "The Court agrees with Mr. Trump's argument because the tweet in question constitutes 'rhetorical hyperbole' normally associated with politics and public discourse in the United States. The First Amendment protects this type of rhetorical statement."

Daniels had claimed Trump had an affair with her in 2006.

Otero not only dismissed the case but also ruled that Trump is entitled to attorney's fees.

CNN quoted Trump's attorney Charles J. Harder as saying, "No amount of spin or commentary by Stormy Daniels or her lawyer, Mr. Avenatti, can truthfully characterize today's ruling in any way other than total victory for President Trump and total defeat for Stormy Daniels.
