Governor Beniwal's sacking a flagrant violation of Supreme Court's ruling, Constitution: Manish Tewari

Congress leader Manish Tewari on Thursday said that the sacking of Mizoram Governor Kamla Beniwal was a flagrant violation of the Supreme Court's ruling , as also the Constitution.

Tewari told ANI, "In 2004, the members of parliament affiliated to the Bharatiya Janata Party had gone to court in a PIL (Public Interest Litigation) protesting against the transfer of certain governors by the then UPA government which was of course legitimately done."

"Subsequently, there was a constitutional bench judge which clearly delineated that because of extraneous political considerations governor should not be removed or transferred. It is incumbent that the Home Minister informs the country as to why the Governor of Gujarat, who is an elderly lady, was first transferred in a cavalier manner to a north eastern state," he added.

Talking about the position of governors, he said, "Governors are constitutional authorities and they cannot be trampled upon. This is a flagrant violation of not only the essence of the Supreme Court judgment but also the constitutional scheme."

Former Gujarat Governor Kamla Beniwal was sacked as Governor of Mizoram yesterday with just two months to go for her term to end . She was earlier shifted from Gujarat to Mizoram. The President on the advice of the Central Government had decided to go ahead with Beniwal's sacking the wake of reports that she was party to alleged land grabbing in her home state of Rajasthan.
