Sessions' Court reserves order in 26/11 Mumbai terror attack case

A Sessions' Court has reserved its order on Mumbai Police's plea seeking to make Pakistani-American LeT terrorist David Headley, an accused in the 26/11 Mumbai terror attack case.

Special Public Prosecutor Ujjwal Nikam informed the court that charges against Headley are distinct and separate from the offences under which he has been punished in the United States.

Nikam added that an American court is not competent to try offences under the Indian Penal Code.

Sessions Judge GA Sanap commented that Headley should have been made a wanted accused in the case. The court also sought to know why the Mumbai Police did not launch an investigation after the United States took Headley's custody.

The court was hearing an application stating that Headley deserves to be tried by the Mumbai court along with Abu Jundal as both are conspirators and abettors. The court has reserved its order till 18th November.

Headley, accused of conducting a special reconnaissance of targets before the Mumbai terror attack, was sentenced to 35 years' imprisonment by a US court. He had entered into a plea bargaining agreement with the US government.
