The files on former Jammu and Kashmir Chief Information Commissioner (CIC) Wajahat Habibullah, including his resignation articles, are reportedly missing, officials have stated.
In response to a Right to Information (RTI) filed by retired Commodore Lokesh Batra on September 7, Central Public Information Officer (CPIO) Sushil Kumar of the Central Information Commission said, "The concerned file containing the communication relating to the then Chief Information Commissioner Wajahat Habibullah's regarding his resignation is not ready traceable though the efforts have been made."
Habibullah resigned in October 2009, but according to media reports, he was advised by the Law Ministry that without a CIC, the commission's orders were open to be challenged in the courts.
Currently, the position lies vacant after Rajiv Mathur resigned in August.
