A Perth Uber driver has sued the ride-sharing company for terminating his account without notice and leaving him with 80,000 Australian dollars worth of car loans, the media reported on Wednesday.

Mike Oze-Igiehon has alleged that Uber breached its contract by failing to pass on negative feedback to him before terminating his account in November 2015. The case is believed to be the first of its kind in Australia, Xinhua news agency reported.

Oze-Igiehon filed a statement of claim in a West Australian court after he rejected an offer from Uber worth 4,000 Australian dollars.

"The company is abusing their status in Australia," he said.

"They are using a loophole in the system to penalise people and I think it's unfair."

Uber responded in a defence filing and said it has the right to deactivate or restrict a driver from accessing the app at anytime.

While a spokesperson would not comment on the case directly, they said the driver feedback is taken seriously.
