The union Home Ministry on Wednesday filed a Special Leave Petition (SLP) in the Supreme Court challenging the Delhi High Court order to the central government over the arrest of a policeman by the Anti-Corruption Branch (ACB) of the directorate of vigilance.
"The ministry has filed a Special Leave Petition (SLP) in the Supreme Court in this regard," a home ministry official told IANS.
The High Court had termed as "suspect" the Centre's recent notification barring the ACB from acting against its officers in criminal offences, saying that the Delhi government had legitimate rights to proceed and take action in complaints of corruption against such officials.
The court had also observed that the mandate of the people "must" be respected by the lt. governor if there was no other "constitutional or legal fetter".
The AAP government in Delhi and Lt. Governor Najeeb Jung have been involved in a public spat over his powers vis-a-vis an elected government.
The home ministry had on May 21 issued a notification siding with the lt governor.
The notification said that the ACB police station shall not take cognizance of offences against officials, employees and functionaries of the central government services.
