Plea in SC against appointment of Justice Gogoi as CJI

The Supreme Court on Tuesday said it will hear on Wednesday a plea challenging the appointment of Justice Ranjan Gogoi as the next Chief Justice of India.

A bench of Chief Justice Dipak Misra, Justice A.M. Khanwilkar and Justice D.Y. Chandrachud asked advocate R.P. Luthra, who mentioned the matter before it for early hearing, to file the mentioning memo before the court master.

Justice Gogoi, one of the four judges who revolted against Chief Justice Misra earlier this year, was on September 13 appointed the next Chief Justice of India (CJI).

Chief Justice Misra will demit office on October 2.

Advocate Luthra along with petitioner advocate Satyaveer Sharma sought quashing of the order of the appointment of Justice Gogoi as the Chief Justice from October 3.

The plea sought adjudication of the question of law for which they are relying on the contents of a press conference of January 12 called by four senior judges including Justice Gogoi.

The petition said: "This act of the four senior most judges of the court was not less than a sabotage to the judicial system of the country. They tried to arouse public furore in the country in the names of certain internal differences in this court."

Justice Gogoi should have been reprimanded for his "illegal and anti-institutional act", they said.
