Rs.41 lakh to kin of MTNL employee killed in accident

A Motor Accident Claims Tribunal (MACT) here has awarded a compensation of over Rs.41 lakh to family members of an MTNL employee, who was killed in a road accident in 2009.

"I hold that petitioner (kin of the deceased) succeeded in proving that Dec 10, 2009, an accident had taken place due to the rash and negligent driving of offending vehicle, being driven by R1 (driver of the car)," MACT presiding officer B.S. Chumbak said in an order, delivered Thursday.

The tribunal directed Reliance General Insurance Company Ltd., with which the offending car was insured, to pay a compensation of Rs.41,85,256 to the kin of 48-year-old Rukmani Devi, who was killed in the Accident.

Family members of Rukmani Devi told the tribunal that she was riding pillion on a motorcycle driven by her husband Dec 10, 2009, and was hit by a car being driven in a rash and negligent manner in Laxmi Nagar here.

As a result, Rukmani fell on the road and sustained grievous injuries. She was taken to a hospital where she died of her injuries.

The tribunal said there were no reasons to disbelieve the testimony of Rukmani's husband, driving the two-wheeler.

The tribunal rejects the submissions of the driver and owner of the offending vehicle that the accident occurred due to the negligent driving of Rukmani Devi's husband.
