2 Army personnel, 1 retired officer granted bail

A local court today granted bail to two Army personnel and a retired officer in a case related to the death of a person, who died after intervening in a dispute between them and a couple at Dalhousie road here recently.
Sessions judge B S Sandhu granted bail to retired Brigadier Arun, his son Lt Col Arjun Kasta and his son-in-law Major Rahul Palak, all hailing from Gurgaon, and were arrested and booked under section 302 (murder) of IPC, on a complaint by the kin of the victim Anil Kapoor (42).
The judge summoned the entire police record and questioned the prosecution on the "cause of death", to which the prosecution replied "due to heart attack". After hearing the accused also, the judge granted bail to the three accused.
Senior Superintendent of Police (SSP) Rakesh Kaushal said police is likely to convert section 302 (murder) imposed on the three accused to section 304 (culpable homicide not amounting to murder) of the IPC.
According to the police, the trio were returning to Lt Col Kasta and Major Rahul's official residence at Mamun Cantonment here after having dinner when their vehicle collided with that of the couple at Dalhousie road here and a verbal spat ensued between them.
Kapoor and his friend Vinay Kumar, who were travelling in a car, intervened in the dispute, police said, adding that the Army officers, who were accompanied by two women, entered into scuffle with Anil, who, as a result, fell on the ground.
Some passersby rushed him to nearby hospital where he was declared as brought dead, police said.
Kapoor's kin had filed a complaint accusing the trio of murder claiming that the push by the officers was the cause of his death.
The trio were then arrested, booked for murder and sent to judicial custody for 14 days by a court of duty magistrate Jarnail Singh, amidst tight security arrangements.
