Slamming the Centre for appointing former Chief Justice of India P Sathasivam as Governor of Kerala, AAP today said the BJP-led government has set a bad precedent due to which, questions will be raised on the verdicts given by the jurist.
"The central government's decision to appoint former Chief Justice of India P Sathasivam as the Governor of Kerala will set a wrong precedent. The BJP-led government may justify the appointment on the ground that it does not violate set procedures, but it compromises independence of the judiciary.
"Appointment of Justice Sathasivam as Governor would give governments an instrument to subvert the independence of judiciary, which would dent the credibility of the institution. With this decision, questions will be raised on the verdicts given by Justice Sathasivam during his tenure as a Supreme Court judge and CJI," AAP said in a statement.
The party also noted that Sathsivam may be asked to quit his post as Governor at the will of the next ruling dispensation.
"If the ruling party at Centre changes before his tenure ends, a former CJI may be asked to quit his post as Governor at the will of the next ruling dispensation," it said.
"The central government's decision and the former CJI's consent does not augur well for the future of democracy in the country, which should have been avoided to keep the independence and credibility of the judiciary intact and to protect the dignity and protocol of the CJI's office," the party stressed in the statement.
