Khan had conducted a sting operation in April showing police personnel attached to the Nehru Nagar police station in suburban Kurla accepting bribe for allowing illegal construction in the area.
Following the sting operation, 36 police officials were suspended and the Anti Corruption Bureau (ACB) registered FIR against them.
Khan's advocate today, however, told a division bench of Chief Justice Mohit Shah and Justice M S Sanklecha that the ACB probe has not progressed and hence a SIT should be formed to look into the case.
The high court would be hearing the matter tomorrow.
