A special court today reserved till December 15 its order on an intervention application filed by activist Anjali Damania alleging overstay of NCP leader Chhagan Bhujbal, an accused in a money laundering case, in a private hospital here.
Bhujbal's counsel today argued that Damania doesn't have any locus to file such an application as she is not part of the prosecution and is only a complainant.
He said Damania can only assist the prosecution and not intervene.
Damania had moved the special court for Prevention of Money Laundering Act (PMLA) cases, alleging that Bhujbal could enjoy treatment at Bombay Hospital due to "sheer negligence of duty by authorities at JJ Hospital and the Arthur Road jail".
The NCP leader was discharged from the hospital on Wednesday and sent to state-run J J Hospital, after his stay at the private facility since November 2, raised eyebrows. He had checked into Bombay Hospital for a thallium scan.
On October 27, special court judge P R Bhavake had allowed Bhujbal to be taken to the private hospital after the court was told that thallium scan, one of the three tests recommended for the accused, could not be conducted at the J J Hospital.
Enforcement Directorate is probing money-laundering case against Bhujbal and his family members in connection with construction of state guest house Maharashtra Sadan in Delhi, and Kalina land scam.
