Madras High Court Bench has sought a reply from Bar Council of India on a petition seeking to ban LLB graduates from unauthorised colleges in Andhra Pradesh and Karnataka from practicing as lawyers in Tamil Nadu.
Petitioner V Ramesh contended that many persons in the state procured law degrees from unauthorised colleges in these two states by paying money and enroll themselves as advocates in various courts across Tamil Nadu.
They obtained bogus degree without attending regular college and the examinations are written by agents/brokers, who sell the seats to candidates from Tamil Nadu, he alleged.
There is no age limit for those enrolling in such colleges and aspirants who obtain these degrees conduct 'kangaroo courts', illegal real estate business and form a nexus with police, thereby degrading the legal profession, he said.
Hence, the petitioner sought a ban on such advocates from practicing in Tamil Nadu.
Justice N Kirubakaran recorded submissions by counsels of all Bar Associations affiliated with the Madras High Court. He also directed the Madurai City Police to submit a report of the registered criminal involvements of such advocates and details of the study centres.
The Judge also heard the transcript of a telephonic conversation allegedly between an advocate and a broker of a college, which was already submitted in the Court.
He directed the Bar Council of India to file a status report in pursuance to the Supreme Court order on the issue and posted the case to August 27 for final hearing.
