"In the absence of any evidence of videography of the alleged sting operation, it will be totally unsafe to charge sheet the police officials for offences punishable under the Prevention of Corruption Act.
"The Investigating Officer (IO) has rightly submitted the closure report. No purpose shall be served by directing re-investigation, as it is not the case of the complainant that recording device containing videography or CD can be traced...." Special Judge Narottam Kaushal said.
Since he was not interested in paying bribe, he had contacted one Rajbir Bansal, a publisher of a small newspaper. In August 2009, Bansal sent a cameraperson for conducting sting. He, however, declined Tomar's request to give him a CD of the sting.
Tomar alleged Bansal had colluded with police officials and blackmailed the traffic police staff and extorted money from them with a promise that he would destroy the CD.
