Court accepts closure report as CD of sting goes untraceable

A Delhi court has accepted the closure report filed by the crime branch in a case of traffic policemen allegedly taking bribe from a transporter as the CD of the sting purportedly showing the act could not be traced.
"In the absence of any evidence of videography of the alleged sting operation, it will be totally unsafe to charge sheet the police officials for offences punishable under the Prevention of Corruption Act.
"The Investigating Officer (IO) has rightly submitted the closure report. No purpose shall be served by directing re-investigation, as it is not the case of the complainant that recording device containing videography or CD can be traced...." Special Judge Narottam Kaushal said.

The court accepted the closure report filed by crime branch in a case registered on the complaint of Shish Pal Tomar in November 2009. Tomar had said he operates RTV buses from Nand Nagri to Ajmeri Gate and the traffic police staff of trans Yamuna area had been harassing him by demanding monthly payment.
Since he was not interested in paying bribe, he had contacted one Rajbir Bansal, a publisher of a small newspaper. In August 2009, Bansal sent a cameraperson for conducting sting. He, however, declined Tomar's request to give him a CD of the sting.
Tomar alleged Bansal had colluded with police officials and blackmailed the traffic police staff and extorted money from them with a promise that he would destroy the CD.

Tomar conducted another video/audio recording in October 2009 wherein officials of traffic staff admitted about the previous incident of sting. A CD of the conversation was prepared and annexed with the complaint.
