Court appoints son as guardian of his "mentally ill" father

District Judge A K Chawla appointed North Delhi resident Vineet Aggarwal as guardian of his 64-year-old father Ashok Aggarwal, who is suffering from brain hemorrhage and paralysis of right side and is unable to speak for the last two years.

Vineet Aggarwal had moved the court for being appointed as the guardian of his father and had also sought its permission to manage his various properties saying his condition has now deteriorated and he is not able to look after his assets.

The court, in its order, also referred to the report of a medical board which said that Ashok Aggarwal needs detailed 'neuropsychological assessment' and he may be referred to the Institute of Human Behaviour and Allied Sciences (IHBAS) for further treatment.

During the adjudication of the son's plea, the wife and the daughter of Ashok Aggarwal gave their no objection to it and also admitted that he was "mentally ill".

"The above-said report, supports the plea of the petitioner (Vineet Aggarwal) that 'the mentally ill person' (father) was unable to either look after himself or manage his properties. Petitioner is none else but the only son of 'the mentally ill person' and there is nothing on record to show that he has any interest, adverse to that of 'the mentally ill person'.

"In view of the foregoing, the prayer is granted and the petitioner (Vineet Aggarwal) is appointed as the guardian of the person of 'the mentally ill person' and the manager of his properties...," the judge said.

The court also noted that when Ashok Aggarwal was produced before it, he was not able to respond when attempt was made to converse with him.
