Additional Sessions Judge Atul Kumar Garg modified the order of a magisterial court and after seeing photographs of the man's shop, held that he must be earning Rs 40,000 to Rs 50,000 per month from his garments business here.
The magistrate had directed the businessman to pay Rs 5000 each per month to his wife and two minor sons, who are living away from him, while the sessions court enhanced the amount to Rs 7,000 each per month.
"Therefore, the order passed by the magistrate is modified to the extent that instead of Rs 5000 per month each, the man will pay an amount of Rs 7000 per month each to the wife and two sons from the date of filing of the petition before the trial court," the court said.
The court also directed the magistrate to expedite the proceedings in the main petition for maintenance and dispose it of within six months.
The woman had approached the sessions court seeking enhancement of the amount claiming that her husband has been earning Rs two lakhs per month from his garments manufacturing business and Rs 5,000 per month was not sufficient.
She alleged that the trial had failed to consider the fact that the man was running garments manufacturing business.
She alleged she was mercilessly beaten up by her husband and his family members since the time of their marriage and that she was deserted by her husband for some other woman.
