Chief Judicial Magistrate Jasbir Singh today rejected the bail application of Rajesh alias Raju who had claimed to be the BMW driver in the May five accident, in which the speeding BMW had hit a Tata Indigo car near IFFCO Chowk here.

Sanjay Sethi and a pregnant woman, Kshama Chopra Shetye died in the accident, while three persons were injured.

No arrest has been made even a week after the mishap.

After the incident, the 'driver' of the BMW ran away while another person in the car, Dakhsh Jaiswal, seriously injured was admitted in the hospital.

The owner of the BMW, Devender Sehrawat has claimed that his driver, Rajesh alias Raju was driving the vehicle when the mishap occurred.

Rajesh surrendered in the local court here on Saturday and verified this version. Police, however, refused to buy this version.

They are suspecting that Suraj Sehrawat, son of Devender Sehrawat, was on the driving seat, but they are yet to establish this.

The court has sought a reply from the Gurgaon police regarding the case. In its reply filed in the court today, police said, Rajesh is not wanted or accused in the case, he is not required."

On the ground of the police report, Justice Singh rejected Rajesh's bail application, saying when he is not accused in the case, how can his bail application be considered by the court.

However, the court directed him to cooperate with the police in the investigation.
