DCW urges Bassi for FIRs in Alka Lamba attack case

DCW chairperson Swati Maliwal today sought Delhi Police Commissioner B S Bassi's intervention in registering FIRs in cases related to the attack on AAP MLA Alka Lamba during an anti-drug drive and BJP MLA O P Sharma's alleged use of foul language against her.
"I would like to bring to your kind attention the proceedings of Delhi Commission for Women (DCW) in the case of Alka Lamba. During the proceedings, SHO Kashmiri Gate gave a written reply stating no cognisable offence is made out in Lamba's complaints and hence no FIR can be filed on the complaint of stone pelting of Lamba and on the public statements of O P Sharma against Lamba," Maliwal said in her letter to Bassi.
The Commission, she said, has taken legal opinion of senior advocate Ramesh Gupta on the reply filed by SHO.
"From the legal opinion, it is clear a case under section 308 of IPC is made out and needs to be investigated further. Also the conspiracy angle in this case needs to be looked into by the police.
"On the second complaint of Lamba against public stataemnts of Sharma, offences under section 509, 503, 504 and 506 of IPC are made out," she said.
"As you can appreciate, it is evident that an FIR should have been registered on both instances as cognisable offences are made out. However, it is sad to note that even in the case where modesty of a lady member of Legislative Assembly of Delhi has been outraged, the police has failed to file an FIR.
"I urge you to immediately intervene and ensure that FIRs are filed in these cases at the earliest," she said.
Maliwal also urged the Commissioner to take suitable action against erring offciers.
