Metropolitan Magistrate Shivani Chauhan, passed an ex-parte order directing the south Delhi resident, who is facing trial in a domestic violence case filed by his wife, to pay her Rs 75,000 for the medical treatment and surgery of their minor son and Rs 7,000 per month towards his school fee.
"The child required medical treatment and surgery but the complainant (woman) being unemployed is unable to meet the expenses.
"The child also requires educational expenses so that his education is carried out uninterrupted," the court said while awarding the interim relief to the woman for her son.
The court noted that denial of financial assistance was economic violence and was covered within the definition of domestic violence under the Act.
The woman had told the court that the child was suffering from Hypospadias disease (related to urination) and has to be operated immediately.
She submitted that the cost of his treatment in Apollo Hospital here was Rs 1,20,000 and she was not in the capacity to arrange the money as she was unemployed.
She had also sought court's directions to the man to pay the child's monthly school fee.
"Other medical expenses to be paid by him to the hospital authorities within three days," the court said.
