Forum asked to restore complaint dismissed for non-appearance

A consumer commission has asked a lower consumer fora here to restore a complaint dismissed by it due to non-appearance of complainant, noting that he had written the date wrongly and a "lenient view" was required.
The Delhi State Consumer Disputes Redressal Commission, presided over by Salma Noor, asked the New Delhi District Consumer Disputes Redressal Forum to restore the complaint filed by Delhi resident Nasruddin.
"We do not find any reason for not believing the version of the complainant/appellant. Policy of law is not to stile a contest. In such circumstances lenient view is required to be taken so as to allow the complaint and the matter may be decided on merit.

"We, therefore, allow the appeal setting aside the dismissal orders...And remand case back to District Consumer Disputes Redressal Forum-III, Janakpuri, New Delhi with a direction to restore the complaint to its original number, and to proceed in case according to law," the commission bench, also comprising its judicial member N P Kaushik, said.
Nasruddin had approached commission seeking a direction to the forum to restore the complaint, submitting that he had mistakenly taken down the wrong date for the hearing and could not appear.
