Forum orders doc to compensate old woman for botched surgery

The Thane District Consumer Redressal Forum (TDCRF) here has ordered a doctor from Bhayander township to compensate a 75-year-old woman, who was allegedly rendered immobile due to a botched surgery at his hospital.
In its order passed last week, Forum President Sneha S Mhatre and Members Madhuri Vishwarupe and N D Kadam held that the respondent doctor Bhaskar Shetty had shown negligence in providing medical aid to the patient and hence was deficient in his services.
The Forum ordered the doctor to refund the sum of Rs 1,29,900 taken as medical bills with 6 per cent interest by December 19, else pay interest at 9 per cent till realization.
In addition to this, the Forum ordered the doctor to pay a sum of Rs 50,000 towards compensation and Rs 10,000 expenses towards the complaint by December 19 or else pay an interest on the sum at 9 per cent till realisation.
In her complaint Mangala Raj Yadav, informed the Forum that her mother Shyamadevi, a resident of Allahabad was suffering from Lumber Spondylosis, and the doctors there had advised her operation of her disc L4-5.
As there was a hospital near her house the complainant brought her mother to Bhayander and got her admitted and operated at the hospital of Dr Shetty.
Towards the hospital bill, she paid an amount of Rs 1,29,900. Besides, Rs 35,000 was spent on medicines.
After the operation carried out by the doctor the patient did not recover and the problem of pain in the spine persisted.
Hence the complainant once again took her mother to Allahabad and got an MRI done with the doctor there who opined that laminoctomy was done at L 2-3 level whereas L 4-5 disc was as it is.
Mangala was advised to refer the patient back to the original surgeon for the needful.
In her complaint the complainant stated that her mother was bedridden for rest of her life due to the carelessness of the doctor and sought compensation from him.
In the order, the Forum stated further that the respondents have not objected to the complaint. Also the documents submitted by the complainant along with the complaint, affidavits and the written submissions, upon persuing them we are of the opinon that it would be proper to accept the matters stated in the complaint.
