Gujarat HC orders ACP to join duty but not before Jan 31

The Gujarat High Court today dismissed a petition challenging the appointment of an assistant commissioner of police, but asked her not to join duty till January 31.
A division bench of Justices Akil Kureshi and A Y Kogje, in May this year, had asked ACP Reema Munshi of special branch to continue her maternity leave until the case was disposed of.
The court today dismissed the petition filed by Neha Parmar who had challenged Munshi's appointment on the ground that she did not meet the selection criteria in the physical test when she joined the force as a deputy superintendent of police.
While rejecting the plea, the high court allowed the petitioner time till January 31 to file appeal, and asked Munshi not to join duty till then.
A single judge of the high court had earlier dismissed Parmar's petition.
Parmar had alleged that the General Administration Department did not follow the procedure regarding physical measurements during Munshi's selection. Parmar herself had failed the physical test.
Munshi's lawyer Vimal Purohit argued that his client was unnecessarily dragged into the case, as the petition really challenged a government procedure.
If his client did not meet the physical criteria, the government should have informed her so that she could have opted for another post, he said.
