HC asks police to give closure report to a petitioner

The Madras High Court today said that police could not act according to their "whims and fancies" in closing complaints given by affected parties and directed them to issue a copy of "closure report" within a week.
The copy of the closure report should be sent to the Judicial magistrate also, Justice S Vaidhyanathan in his common order on a series of criminal original petitions said.
Police should give closure report in case they were closing a complaint within a week to the complainant and the plaintiff could seek alternative remedy as per law, the judge said.
Police should hear the concerned parties. In case the police does not register any case on the ground that the averments in the complaint does not fall in any one of the conditions mentioned in the order of the High Court or Supreme Court, the petitioners could give private complaint in a Judicial Magistrate court, the judge said.
One of the petitioners S Venkataramanan told the court that he had been cheated to the tune of Rs 15 lakh by one Sadhasivam. He had given a cheque for the amount.
However, Sadhasivam and his uncle Shanmuganathan, who is a DSP were threatening him and abusing him for complaining to police, Venkataraman contended.
The district crime branch was not taking any action on his complaint. The DSP was threatening to withdraw the case. Police were not even giving any closure report also, he said.
