The bench, comprising Justice Girish Gupta and Justice S S Sadhu, declined to hear the bail prayer of Assamese singer Sadananda Gogoi, who is under arrest, on personal grounds when the plea came up before it.
The bench also recused from hearing the application by CBI for cancellation of bail of key East Bengal club official Debabrata Sarkar alias Neetu.
CBI arrested Gogoi on September 13 last year from Guwahati in connection with the Saradha scam which had spread its wings in Assam, apart from West Bengal, Odisha and Tripura.
He was, however, released on bail on March 25 by the Alipore District and Sessions Court.
CBI then moved the high court seeking cancellation of bail of Sarkar.
