The petitioner stated that Muniyappa, was elected to Lok Sabha continuously from Kolar (reserved) constituency, in Karnataka right from 1999 to 2009.
The petitioner had alleged that Bangalore Development Authority had allotted sites bearing No 566,567 measuring 60 ft x 80 ft in Katriguppe, Banashankari Stage 3, under "G" Category to Muniyappa on July 22, 2002, while he was a Lok Sabha MP.
