A bench of Justice Shantanu Kemkar and Justice Moolchand Garg cancelled the notification published in the State Gazette on February 5, 2013, after hearing arguments from the state and the petitioners.
The notification had sought to bring these 29 villages which are under 23 village panchayats, under the IMC limits.
As per the PIL, the provisions of Madhya Pradesh Nagar Palika Adhiniyam, 1956 were not followed before issuing the said notification.
"IMC is unable to provide basic facilities like drinking water and sanitation to majority of people living in its limits", said activist and one of the petitioners Anil Trivedi.
