HC directs deceased govt employee's arrears to be paid from IAS officer's pension

A single-judge bench of the Rajasthan High Court today directed the state government to recover damages for the illegal termination of a Rajasthan State Handloom Development Corporation (RHDC) employee, since deceased, from the pension of retired IAS officer Umrao Salodia and another person.
According to the petitioner, the matter pertained to the "illegal" retrenchment of Shashi Mohan Mathur, who had joined the RHDC in 1991 and remained on probation till 1996.
However, owing to "false" charges of embezzlement, he was retrenched and IAS Umrao Salodia, who was then in charge of the RHDC, dismissed his appeal without granting him a hearing, the petition alleged.

Mathur had approached high court in 2002. He passed away subsequently and his wife continued to fight the legal battle.
A bench of Justice Sanjeev Prakash Sharma directed that Mathur be treated as being employed and his arrears recovered from the pension and other post-retirement benefits of Salodia, who was in the news for converting to Islam after he was not appointed the chief secretary by Chief Minister Vasundhara Raje.
The bench directed that the recoveries be made within four months.
