Observing that all are equal before law, Madurai Bench of the Madras High court today directed the Dindigul Police to apprehend the culprits who included three lawyers, who trespassed into the land of one Murugan for which one T Sridharan was holding power of attorney and put up an office.
Justice N Kirubakaran in his interim order said a perusal of the records showed that the petitioner got power of attorney from the owner of the property Murugan. "It is clear that the petitioner is absolute possession as a power agent of the entire property".
The contention of the police that Chinnasamy, who entered into agreement with the owners of the property Sathiskumar and Rajkumar in 2012 and was in possession was not correct the judge said, adding, it is well settled law that agreement cannot confer any title to the property.
Besides Nowhere in the agreement it was shown that the possession of the portion was given to Chinnasamy. If any portion was in occupation by Chinnsamy or any of the person it was by way of encroachment and his possession was illegal.
A perusal of the photographs would show that advocate office board had been put up in the premises. If any body trespassed into the property and attacked the petitioner's mother, it was the duty of the police to arrest those culprits and proceed in accordance with law.
The petitioner said that the property belonged to T Rajkumar and T Sathishkumar. They had sold the property to One Murugan.Murugan gave him power of attorney. When the petitioner made arrangement to sell the property, some unruly elements insisted that he should sell proper for them at a lower price.
The petitioner did not agree. Then a group of advocate trespassed into the house where the petitioner's aged mother was residing and forcibly threw her out of the premises. In this regard the Petitioner gave a complaint but police did not take any action.
