Dismissing an appeal by D Mayakannan, whose father was a teacher in a panchayat union primary school and had died in harness on September 23, 1992, Justice V Ramasubramanian and N Kirubakaran said the petitioner's elder brother was aged 24 years when their father died but he did not apply.
The judges said now Mayanakkan had made the application after 23 years and as such it cannot be considered by the court. They said a single judge bench was right in rejecting the plea on Sept 24, 2010.
He then approached the High Court, which sent the matter to the department. But the government rejected it on March 16, 2009. The order was challenged through a second writ petition but a single judge rejected the claim, prompting him to go in appeal.
