HC dismisses plea for appointment on compassionate grounds

The Madras High Court today dismissed a man's plea for appointment as a teacher on compassionate grounds, holding it cannot be considered after his father's death 23 years ago.
Dismissing an appeal by D Mayakannan, whose father was a teacher in a panchayat union primary school and had died in harness on September 23, 1992, Justice V Ramasubramanian and N Kirubakaran said the petitioner's elder brother was aged 24 years when their father died but he did not apply.
The judges said now Mayanakkan had made the application after 23 years and as such it cannot be considered by the court. They said a single judge bench was right in rejecting the plea on Sept 24, 2010.

Mayakannan submitted that he had applied for appointment on compassionate grounds on December 21, 1993. After 14 years, particulars of financial status of the family was sought and thereafter the request was rejected on September 11, 2007.
He then approached the High Court, which sent the matter to the department. But the government rejected it on March 16, 2009. The order was challenged through a second writ petition but a single judge rejected the claim, prompting him to go in appeal.
