HC dismisses plea on murder case

The Madras High Court has declined to entertain a plea seeking a direction to the Tamil Nadu government to register a murder case against two police personnel who allegedly killed an accused involved in a multiple murder and rape case in 2010.
The case relates to the rape and murder of a 10-year-old girl after she was kidnapped along with her seven-year-old brother in Pollachi.
According to prosecution, Manoharan along with prime accused Mohanakrishnan had abducted the siblings on October 29, 2010 with the aim of demanding ransom from their father, a textile merchant.
However, they raped the girl and murdered her and her brother who was a witness to the crime. They later threw the bodies in a canal near Pollachi. Mohanakrishnan was shot dead by police in an alleged encounter when he tried to escape after his arrest.
A case was registered in this connection in 2010.
DSP, CB-CID, Chennai, investigated this case and prepared a report to be submitted to the jurisdictional magistrate.
Advocate P Pugalenthi filed the present petition seeking a direction to register a murder case against police personnel Annadurai and Muthumalai.
A division bench, comprising justices M Jaichandran and S Nagamuthu, before which the petition came up, said Deputy Superintendent of Police, CB-CID, has already completed the investigation and the report is ready to be filed before the jurisdictional magistrate.
"We do not want to express any opinion regarding the sufficiency or correctness of the Investigation done by him, as expressing any opinion may influence the mind of the Magistrate before whom the final report is going to be filed."
The bench said "there is no material to even remotely infer that an attempt has been made by the police to dilute the investigation."
"There is no merit as of now in the writ petition," the bench said and dismissed the petition.
